AHP satisfied with diploma on relations between hotels and OTA's

A Associação da Hotelaria de Portugal (AHP) is clearly satisfied with the publication of the diploma that aims to guarantee cfair and balanced market conditions entre as hotel companies and OTAs (Online Travel Agencies).

For this purpose, this new law changes the competition regime, the regime of individual restrictive trade practices and the regime of general contractual clauses.

The main innovations are the prohibition of price parity clauses; the prohibition of resale by third parties at a lower price and the prohibition of excessive or discriminatory remuneration fees. The Decree-Law now published enters into force on the day 01 de Janeiro.

It should be recalled that AHP has long requested the intervention of Governments in this matter, considering that hotel companies in Portugal were at a competitive disadvantage, of lesser negotiating capacity and abuse of a dominant position.

Remember that since July 2020 which is applicable, across the European Union, a regulation on relations between economic operators and online platforms.

This is a very important change for the hotel industry in Portugal, afirma Cristina Siza Vieira, vice-president executiva and AHP, adding that Portuguese hoteliers have been at a clear disadvantage for a long time., not just about the big rigs, but even before other countries.

The official also says that these changes will allow fairer and more balanced market conditions for companies that depend largely on digital platforms, and who are partners, because the search requires it, mas, because they had no bargaining power in relation to these large global companies, they had to accept the conditions that these imposed on them.
